NIL Reporting Form
● Student-athletes (SA's) may earn compensation for their name, image, and likeness (NIL).
Such compensation must be within fair market value and must be for actual work/services
performed.
● Saint Mary’s University of Minnesota, its athletic department, and/or staff members may not
compensate or arrange compensation to a current SA or prospective student-athlete (PSA)
for that SA’s or PSA’s NIL.
● Representatives of athletics interests ("Boosters") may only compensate or arrange
compensation to a SA or PSA if such compensation is with a business/company in which the
Booster has a direct relationship (owner, employee, etc.)
● Neither Saint Mary’s University of Minnesota nor any third party (booster, company,
business, etc.) may provide compensation to a SA/PSA in exchange for athletic performance
or attendance at the university.
● NIL compensation opportunities (and the activities associated with those opportunities) must
not conflict with academic or team-related activities.
● SAs/PSAs may not secure NIL compensation from the following business sectors:
○ Adult entertainment products or services
○ Sports gambling
○ Alcoholic beverages
○ Tobacco products
○ NCAA banned substances
○ Weapons
● SAs/PSAs will be allowed to use university or athletic department related marks and logos,
including all aspects of the uniform in association with any NIL activity or opportunity. The
university reserves the right to rescind right if student-athlete conduct issues arise.
● SAs are not permitted to enter into NIL agreements with gambling/sports wagering vendors,
any and all alcohol vendors, or any vendors associated with athletic performance-enhancing
drugs.
● The use of athletic department facilities in any NIL activity or opportunity will require approval
in advance from the athletic department
● The duration of a contract for representation of SA or compensation for the use of NIL should
extend only through participation in an athletic program at Saint Mary’s University of
Minnesota.
● SAs may secure representation (agent or lawyer) ONLY for NIL and NOT for future
professional athletic contract negotiations. SAs must not have entered into any such written
or oral agreements for NIL prior to 7/1/21.
● A SA under the age of 18 must have parent/legal guardian approval prior to entering into any
contract for compensation for the SA’s NIL.
● International SAs should not enter into any NIL agreements without consultation with the
International Office on potential immigration issues.
● Saint Mary’s University of Minnesota and its athletic department will monitor this changing
landscape and will provide updates to athletic staff and student-athletes as more information
is known. It will also provide educational information to student-athletes on NIL
● SAs and PSAs should be advised that Pell Grant or need-based financial aid could be
impacted based on compensation from NIL. Those questions should be directed to the
university’s Financial Aid Office.
● SAs must disclose any NIL activities by submitting a completed Name/Image/Likeness
Disclosure Form, and receive approval from the university's athletic department prior to
engaging in the activity. . This temporary policy will remain in place until federal legislation or
new NCAA rules are adopted
● A SAs involvement in NIL activities will not relieve the SA from the obligation to comply
with all NCAA, university and athletic department academic standards, requirements,
regulations or obligations; team rules of conduct or other applicable rules of conduct;
standards or policies regarding participation in intercollegiate athletics; or disciplinary
rules and standards generally applicable to university students.
● SAs are not permitted to sell or trade any equipment, apparel, awards or complimentary
admissions provided to them by the athletic department as part of any name, image or
likeness activities.
Saint Mary’s University of Minnesota will continue to assess the NIL landscape and reserves the
right to modify these guidelines, if necessary.
